TERMS & CONDITIONS OF BUSINESS

 1. Applicability

By ordering goods and/or services from us you are deemed by us to have knowledge of and to have accepted that, except insofar as they are varied in writing by a director of Tinnisoothe, these express Terms and Conditions will (a) apply, and (b) prevail, if applicable, over your terms, conditions and stipulations.

 2. Ownership of Goods – Title & Risk

We remain sole and absolute owner of the goods and Title to them remains with us until our account has been settled in full, but Risk in the goods passes to you upon dispatch – see 3, 4 and 5 below.  Title does not pass by reason of our delivery of the goods or your acceptance of the same.

 3. Loss & Damage

Please examine the goods upon receipt and advise us within seven days of any damage or deviation from the order you placed with us. We cannot accept a loss or damage related returns claim once seven days has passed, as after this date the goods in question shall be deemed to be of merchantable quality and in accordance with your requirements, and you shall be bound to pay for the same.

 4. Returns, Refunds and 30-day Money Back Guarantee

We strive to provide complete satisfaction to our customers, however in the rare case you need to return your item to us, please refer to our Returns Policy for details of returns and refunds in different scenarios.

Please note, all returns must follow the returns process and be sent with tracked postage. We cannot accept any responsibility for the returning of items until they have been received by us. Items not returned using the correct process will not be eligible for return processing, replacement, or refund. If you have any questions, please use the ‘Contact Us’ link at https://tinnisoothe.com/contact and select ‘Returns Query’ in the dropdown menu.

We reserve the right to investigate the returned item before sending out a replacement or issuing a refund, to check that the item has not been damaged or lost due to user error. This includes, but is not limited to: evidence of water ingress, excessive use of force on plastic components, misuse of charging apparatus, evidence of tampering, battery degradation and/or general wear and tear.

Most problems can be solved with simple troubleshooting or replacement of accessories, such as clips. Before you return your item, please be sure you have referred to your user guide and our helpful FAQ page at https://tinnisoothe.com/faqs. Remember, you can also find some spare accessories in the box.

5. Warranty Policy

A standard 1-Year Warranty applies to the TinniSoothe® module and TinniSoothe® docking cradle, with the 12-month period commencing from the original dispatch date. The 1-Year Warranty also includes the lithium battery, but excludes all external accessories (e.g. lanyards, clips, USB cable)

If the unit becomes faulty and you cannot rectify the problem via our FAQ section, simply contact us using the ‘Contact Us’ link at www.tinnisoothe.com/contact and select ‘Warranty Claim’ in the form. Most issues can be solved through simple troubleshooting. If not, you can return the item to us. We will then test the unit and let you know if there is a fault. If in the rare occasion we do find a fault, we will either repair the unit or send you a replacement unit with brand new accessories if necessary.

The 1-Year Warranty only applies if the unit has not been incorrectly used or mishandled in any way that excludes its designed purpose. We withhold the right to decline the 1-Year Warranty if we believe there has been misuse or foul play.

6. Payment & Delivery Terms

Prices are quoted inclusive of VAT unless otherwise stated.  Unless otherwise agreed in writing, payment for goods together with applicable taxes is due at the time of purchase

During the checkout process, you will be asked to enter your payment details. By completing your payment details you confirm that the credit or debit card being used is yours. All fields indicated as compulsory must be completed. Please note that we may collect and store your information for up to 6 months after your last payment and possibly longer, using an encrypted secure payment accounting software and will only use your information in accordance with our Privacy and Cookie Policy.

Purchases will be made in Pounds Sterling by default. International credit card providers or banks will determine the exchange rate and may add an additional processing or administration charge in relation to such payment which international credit card holders will be liable to pay. This is made less likely with our use of the PayPal / Stripe checkout system.

Delivery

Delivery charges and timescales vary depending on the type of products ordered and the delivery address.

Please note that certain products may be subject to alternative delivery charges, restrictions and/or time scale alterations.

All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order.

We shall be under no liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.

In the UK, delivery charge refunds can only be made in accordance with your legal rights under the Consumer Protection (Distance Selling) Regulations and other applicable legislation. Similar rights may apply for some international deliveries. For further information about your legal rights your local authority Trading Standards department or consumer advice centre (for example the Citizen’s Advice Bureau for UK customers).

International Delivery

Due to customs, legal, regulatory and certain practical restrictions applicable to orders placed for international delivery, some of our products may not be available for delivery to certain destinations outside the UK.

International Tax & Duties

If you are based outside of the UK, your purchases may be subject to import tax or duties that you will need to pay before the order can be delivered to you. As these vary by country, we aren’t able to predict or influence what fees will be applied. Tinnisoothe recommends that you contact your tax office to find out what fees you are likely to incur.

Delays

Where the supply of your product(s) is delayed or prevented for reasons beyond our control (for example, material shortages, import delays or higher than anticipated demand) we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.

7. Returning Goods

You are responsible:

7.1 for the cost of returning anything to us unless specified; and

7.2 for any damage or loss to the goods until we receive them.

We therefore recommend that goods to be returned by mail are sent by Registered, tracked and signed for post offering full compensation and guaranteed delivery. Other options are not recommended as compensation is limited and delivery is not guaranteed. In any event, you should ask for a free-of-charge “Certificate of Posting” and keep this for a minimum of three months.

8. Patents, Registered Designs, Copyrights & Trademarks

Regardless of whether or not our products and designs are protected by patent, registration, copyright, trademark or other legal device, you agree that except with our prior written permission you will not:

8.1 imitate;

8.2 copy; and/or

8.3 derive commercial advantage from our products or designs or from any characteristic, aspect, feature, part and/or property of our products or designs.

9. No Waiver

A failure by us at any time or for any period to enforce any one or more of the Terms and Conditions shall not be a waiver of the right to enforce such Terms and Conditions on a future occasion.

10. Headings and Singularities/Pluralities

The headings used in these Terms & Conditions are for convenience only and have no legal effect.  Singulars and Plurals are interchangeable as circumstances require.

11. Governing Law & Jurisdiction

All matters arising out of the relationship between you and us shall be interpreted or construed in accordance with English Law and you and we agree to submit to the jurisdiction of the English courts.

12. The success of Tinnisoothe is neither guaranteed or implied.

13. The TinniSoothe device will be supplied to the best of our ability in perfect working order ready for use. All units are tested immediately prior to dispatch. However the liability of Tinnisoothe Ltd shall not exceed the purchase cost.

14. Only one price discount offer at a time will apply.

WEEE Waste Disposal

One of the provisions of the European Directive 2002/96/CE is that anything electrical or electronic should not be treated as domestic waste and simply thrown away. To remind you of this Directive all affected products are now being marked with a crossed-out ‘wheelie bin’ symbol, as depicted below

To comply with the Directive, you can return your old unit to us for disposal. Simply place the unit into a padded bag or envelope, and post the unit back to us using the following address:

Upon receipt we will send your old device for components recovery and recycling to help to conserve the world’s resources and minimise any adverse effects on the environment.
